Suzanne McKie, managing partner at Farore Law, which specialises in misconduct in the workplace, says the Odey case is an opportunity for the FCA to articulate exactly what behaviour is likely to fall foul of the individual conduct rules and when it expects financial institutions to intervene.
It will also provide the chance to establish the kinds of conduct that will most probably lead to the FCA starting an investigation.
“This is an opportunity for the FCA to state not only what kinds of conduct are inappropriate and, potentially in breach of the code of conduct, but whether the FCA’s remit is also covered by inappropriate behaviour that occurs outside the workplace,” she adds.
“There will be, and most probably needs to be, a greater number of firms and companies investigating not only individuals, but the firms themselves for either turning a blind eye or not having sufficiently robust systems in place in order to detect poor behaviour.”
