We set out below some recent litigation successes –
- We acted for the Chairman of a public listed company in a complex whistleblowing claim involving allegations of fraud and misleading investors. After the Chairman blew the whistle, the company dismissed him on grounds of gross misconduct (pursuant to a grossly unfair disciplinary process), thereby affecting his ability to seek alternate employment as a FCA regulated individual. We issued proceedings in the Employment Tribunal claim against the company and various Individual Respondents. We managed to secure a high value settlement agreement a month before the final merits hearing, after we succeeded in obtaining specific disclosure on documents which were damaging to the Respondents’ defence. As part of this settlement agreement, the Respondents agreed to retract the gross misconduct allegations. This enabled our client to continue with his career and reputation intact.
- We acted for an LLP member and one of the largest employee shareholders of a professional services firm in a disability discrimination claim. A large part of his remuneration comprised of shares, which were the subject of a forfeiture and clawback provision. Following his dismissal, the entirety of his shareholding was forfeited by the employer. The matter was settled on the day before the first public hearing in the Employment Tribunal, where we managed to secure a multi-million compensation package for our client to compensate for his significant financial losses.
- We acted for Sun Mark Ltd and six individual Respondents (including a peer of the realm) in a complex, high-value sex discrimination, harassment and victimisation claim. We managed to persuade the Employment Tribunal to strike-out the Claimant’s claim to a remedy after it transpired that she destroyed crucial evidence for the remedies hearing. The Employment Tribunal’s strike-out judgment was upheld by the Employment Appeal Tribunal in R Kaur v Sun Mark Ltd [2024] EAT 41.
- We represented a city trader in a hard-fought claim of unfair and wrongful dismissal and succeeded in all counts. Our client was seeking re-instatement and the case ended up in a settlement.
- We are currently acting for a former senior executive of a finance house in a multi-million-pound claim. As part of the disclosure process, the Respondents disclosed heavily redacted documents due to confidentiality reasons and refused to disclose a series of relevant documents to the claim. Following a 2-day preliminary hearing in the Employment Tribunal, we succeeded in obtaining orders requiring the Respondents to disclose the redacted documents in unredacted form and to provide specific disclosure of large volumes of documents which they had initially resisted to provide voluntarily.
