What is a Full Merits Hearing?
A Full Merits Hearing, or “FMH” is the hearing that decides if the claim succeeds or fails. If the claim is successful, the hearing may also determine the appropriate remedy, but this may also be reserved for a separate hearing. Typically, in Tribunal cases, the issues relevant to liability will be dealt with at the FMH, alongside any key issues that may significantly reduce or limit the amount of the Claimant’s remedy, such as a “Polkey” argument that even if the breach of internal disciplinary procedure had not occurred, the Claimant would still have been fairly dismissed.
